Terms of Use

These Terms of Use (the "Terms") are entered into between ECW EURL (a single-member limited liability company, hereinafter "ECW"), operating the ObotCall brand, and the User. They govern the use of the ObotCall services, comprising:

• Inter: Multi-trade field service management
• Autopublish: Automated content publishing and distribution to social networks

By accessing and using our services, you unreservedly accept these Terms.

3.1 Registration

Access to the Services requires the creation of an Account. You must provide accurate, complete and up-to-date information. You are responsible for keeping your login credentials confidential.

3.2 Eligibility

Our Services are reserved for professionals and persons of legal age. By creating an Account, you represent that you have the legal capacity to enter into a contract.

3.3 Activation

Your Account is activated once your registration has been validated. ECW reserves the right to refuse any registration without having to justify its decision.

5.1 Compliant use

You undertake to use the Services in accordance with their intended purpose and in compliance with the laws and regulations in force.

5.2 Prohibitions

It is strictly prohibited to:

• Use the Services for illegal or fraudulent purposes
• Attempt to access other users' accounts
• Disrupt the operation of the Services
• Collect data without authorization
• Distribute viruses or malicious code
• Circumvent security measures
• Resell or sublicense the Services without authorization

5.3 Content

You are solely responsible for the Content you upload and distribute through the Services. You warrant that you hold all the necessary rights to such Content.

6.1 ECW's rights

All components of the Services (software, databases, designs, trademarks, logos), including the ObotCall brand and trademark, are the exclusive property of ECW and are protected by copyright and trademark law.

6.2 License of use

ECW grants you a non-exclusive, non-transferable and revocable license to use the Services, limited to the duration of your Subscription.

6.3 Your Content

You retain all rights to your Content. You grant us a license to use this Content solely for the purpose of providing the Services.

7.1 Availability

We strive to ensure maximum availability of the Services, but cannot guarantee 100% availability. Interruptions may occur for maintenance or due to force majeure.

7.2 Technical support

The level of technical support varies depending on your Subscription plan. Details are available on our pricing page.

7.3 Changes

ECW reserves the right to evolve the Services, adding or removing features, subject to prior notice.

9.1 ECW's liability

ECW shall not be held liable for indirect damages (loss of data, revenue or opportunity) arising from the use of, or inability to use, the Services.

9.2 Limitation of liability

In any event, ECW's liability is limited to the amount of the sums actually paid by the User over the past 12 months.

9.3 User liability

You are responsible for your use of the Services and for your Content. You undertake to indemnify ECW against any claim related to your use of the Services.

10.1 Term

The Services are subscribed for the term chosen upon Subscription (monthly or annual) and renew automatically unless terminated.

10.2 Termination by the User

You may terminate your Subscription at any time from your Account. Termination takes effect at the end of the current period. No refund is issued for the period already paid.

10.3 Termination by ECW

ECW may suspend or terminate your access to the Services in the event of a breach of these Terms, subject to prior notice except in an emergency. In the event of termination for fault, no refund is due.

10.4 Effects of termination

Upon termination, your access to the Services is deactivated. You have 30 days to retrieve your data; after this period, it will be permanently deleted.

These Terms are governed by French law.

In the event of a dispute, the parties shall endeavour to reach an amicable solution. Failing this, the dispute shall be brought before the courts having jurisdiction over ECW's registered office.
